“Foundation”
The Babyn Yar Holocaust Memorial Charitable Foundation aims to establish a museum, scientific and educational complex within the territory of the Babyn Yar ravine in Kyiv – the Babyn Yar Holocaust Memorial Center, whose mission is to honor and perpetuate the memory of victims of the Babyn Yar tragedy and promote humanization of mankind by preserving and studying the Holocaust history and researching and covering genocide issues, opposing to hatred and human rights violations, accumulating and disseminating knowledge about the crimes of genocide in order to perpetuate the memory of the dead.

“Closed Eyes”
one of the projects of the Foundation, that is public, constantly updated and designed to compile the most complete martyrology of Russo-Ukrainian war victims among residents of Ukraine starting from 2014.

“Site (Website)”
a multimedia online platform created for the purpose of exchanging, analyzing, preserving the memory and systematizing information through family ties, photographs, memories of loved ones and bibliographic data in order to perpetuate the memory of those killed in the Russo-Ukrainian war. The owner of the Site is the Foundation. The Site was created within the framework of the Closed Eyes project in order to immortalize the names of those who fell innocent victims as a result of the Russian military aggression in Ukraine.

“User”
any individual or representative of a legal entity who has access to the Site and uses resources of the Site via the Internet.
“Moderator”
a representative who monitors compliance with the Terms of Use of the Site and is responsible for administration, pre-moderation and post-moderation of User publications in the Site.

“Materials”
photos, information from archives, biographical data, documents, videos, analytical materials and all other materials posted on the Site.

“Site Content”
any content, data, programs, videos and software applications available on the Site.

“Personal Data of the User”
any information that identifies or can be used to identify the User who provides such data, including, but not limited to cookies, tags, IP address tracking/URL tracking and other tools. The User authorizes the Foundation and its affiliates to collect, process, store and use personal data for the purpose of using and registering with the Site, as well as to include such information in special databases (of users) of the Foundation.

Deceased Person Details
information about a deceased person. That is, circumstances of a person’s death, state of their health at the time of death, cause of death, including the one related to medical secrecy, and other similar information of public interest with respect accorded to a deceased person.

“Legal Interests”
processing of personal data of Users by the Foundation or a third party authorized by the Foundation provided that such interests do not prevail over the rights and interests of the User. The Legal Interests include:
● obtaining information about the User’s behavior on the Site;
● developing and improving Site services;
● interests that allow the Site to improve, configure or change services and communications;
● determining the effectiveness of Site marketing campaigns;
● increasing data security;
● providing the User with access to the Site;
● public interest and the right of the public to know socially important information. Legal interests shall be deemed valid only to the extent they do not prevail over the rights and interests of the User.
